Use of Content  

By entering in the sweepstakes (“Sweepstakes”) you hereby grant to the Permitted Parties the right and license to use, distribute, publish, exhibit, modify, edit, digitize, broadcast, display, reproduce, and otherwise exploit the Content, on the Permitted Parties’ websites, emails, Youtube and social media channels, throughout the world, for purposes of unpaid advertising or trade in perpetuity from the go live date of the Content and paid advertising or trade in perpetuity from the go live date of the Content (collectively, the “Posting Period”). Following the expiration of the initial Posting Period, the parties agree that Content shall be allowed to live on the Permitted Parties sites but shall not be actively reposted. 

A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. 

1. Sweepstakes Timing: ONE/SIZE hosts Sweepstakes through their loyalty program with Bubblehouse on a 2-month cadence and can be adjusted at any time by ONE/SIZE. 

2. Eligibility: The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older as of the last day of the month prior to date of entry.  

HOW TO ENTER THE SWEEPSTAKES:  

a. You may enter the Sweepstakes by visiting https://www.onesizebeauty.com/apps/bubblehouse/rewards/ (the “Website”) to log in or register to become a member of ONE/SIZE rewards. After registering or logging in, complete the steps to be entered to win.  

All entries must be received by 11:59 p.m. PST before the day the Sweepstakes ends. Prizes are subject to availability and are at the sole discretion of ONE/SIZE. Any attempt by any entrant to enter by using multiple/different email addresses, mailing addresses, identities, registrations and logins, or any other methods will void such entries and that entrant may be disqualified. Use of any automated or computer system to participate online is prohibited and will result in disqualification. Normal Internet/phone access and data/usage charges imposed by your online/phone service may apply. Entries cannot defame, misrepresent or contain disparaging remarks about ONE/SIZE or any of its products, or other people, products or companies or communicate messages or images inconsistent with the positive images and/or goodwill to which ONE/SIZE associates. ONE/SIZE reserves the right to monitor and will monitor Entries and delete, if required in its sole discretion. By entering, you acknowledge that your entry may be posted on the ONE/SIZE’s Website(s) or other media pages, in ONE/SIZE’s sole discretion. ONE/SIZE shall have full right and power to copy, publish, broadcast, display, distribute, use, edit, translate, alter, combine with other material, reuse and adapt any or all portions of the Entries in any way and for any purpose whatsoever, at any time, now or in the future, in any media now known or hereafter devised throughout the world in any manner whatsoever and for any purpose. Entries that are not in accordance with these Official Rules as stated herein or are not received during the Sweepstakes Period will be ineligible. Entries cannot (a) be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, contain nudity or any materially dangerous activity; (b) promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (c) be obscene or offensive, endorse any form of hate or hate group; (d) contain trademarks, logos or trade dress owned by others, or advertise or promote any brand or product of any kind other than ONE/SIZE owned brand/products; (e) contain copyrighted materials owned by others without permission (except as specifically requested for the Post); (f) contain materials embodying the names, or other indicia identifying any person, living or dead, without permission; and (g) depict, and cannot itself, be in violation of any law.

5. Random Drawings: Drawings will be conducted by Administrator and shall be at random.   Decisions are final on all matters relating to the Sweepstakes. 

6. Winner Notification: The potential prize winner will be notified via email and must respond confirming their eligibility and providing a valid mailing address within three (3) days or prize will be forfeited and an alternate winner will be selected.  

8. Warranties and Representations; Release of Liability: You hereby hold the Released Parties, Meta Platforms, Inc., and Tik Tok harmless from and against any third-party claim arising from use of any Entry and you waive any right to inspect or approve uses of your Entry by ONE/SIZE in connection with the Sweepstakes or to be compensated for any such uses. Participating in the Sweepstakes constitutes permission to the ONE/SIZE to use a winner’s name, address, likeness and Entry in connection with the Sweepstakes only and as otherwise required by law. By participating in the Sweepstakes, the entrant/winners/guest agree that Released Parties will have no liability whatsoever for, and will be held harmless by entrant for any liability for any bodily injury, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from entry, the acceptance, possession, use or misuse of a prize or component thereof, if applicable, travel or participation in the Sweepstakes or participation in any Sweepstakes related activity. You hereby represent and warrant that you have read these Official Rules and are fully familiar with their contents and agree to be bound by them. 

9. General Rules: By participating in the Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the ONE/SIZE and/or Administrator which are final. Winning a prize is contingent upon fulfilling all requirements set forth herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Entries become the property of the ONE/SIZE and none will be acknowledged or returned. ONE/SIZE accepts no liability for printing errors on material(s) distributed for this Sweepstakes nor will any responsibility be taken for lost or late entries or for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized on any Website or the Sweepstakes or by any human error which may occur in the processing of the entries in the Sweepstakes or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the Website or Sweepstakes. In the event of a dispute as to any entry, the authorized account holder of the email address associated with the Website account will be deemed to be the entrant. Winner may be required to show proof of being the authorized account holder of the email address associated with the entry. Proof of entering information via the Website does not constitute proof of delivery or receipt of such information. ONE/SIZE is not responsible for the failure of any entry to be received by ONE/SIZE on account of technical problems or congestion on the internet or at any website/Website. The ONE/SIZE reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or the Website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes or the Website may be a violation of criminal and civil law, and, should such an attempt be made, ONE/SIZE reserves the right to seek damages from any such person to the fullest extent permitted by law. ONE/SIZE's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the ONE/SIZE which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes or the Site, then the ONE/SIZE reserves the right at its sole discretion to cancel the Sweepstakes, in whole or in part, a notice will be posted at the Website and the random drawing to award the prizes will be conducted from among all eligible entries received prior to cancellation. ONE/SIZE reserves the right to modify the Sweepstakes or disqualify entrant if fraud, misconduct or technical failures destroy the integrity to the Sweepstakes as determined by the ONE/SIZE, in its sole discretion.  

10. Governing Law: The Sweepstakes and the Official Rules shall be exclusively governed by and construed in accordance with the laws of the State of Ohio, without regard to conflicts of law provisions. Entrants submit to exclusive personal jurisdiction in Ohio and agree that any dispute shall be brought in the state or federal courts in Ohio. You agree that: (a) any and all disputes, claims and causes of action arising out of, or connected with the Sweepstakes or prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Ohio; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (c) notwithstanding the foregoing, you waive the right to claim any damages, whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages.
