ONE/SIZE STARRR SEARCH CONTEST RULES (“Official Rules”)

NO PURCHASE NECESSARY TO ENTER OR WIN THE ONE/SIZE STARRR SEARCH CONTEST (“Contest”) Entry into this Contest constitutes your acceptance of these Official Rules.  Winners may be required to execute and return additional release documents as more fully described below.

CONTEST ENTRY DATES: The Contest will begin on August 24, 2020 at 12:00 am EST and end on September 16, 2020 at 11:59pm EST (the “Contest Period”).  To be eligible entrants must submit their video entry via the submission form on onesizebeauty.com before 11:59pm EST on September 16, 2020.  The Contest will not be responsible for misdirected, incomplete, undelivered or delayed entries no matter what the cause.  All entries become the property of Sponsor and will not be acknowledged or returned.

WHO MAY ENTER:  Contest is open to legal residents of the 50 United States and District of Columbia, age eighteen (18) years or older at the time of entry, except employees, their spouses and immediate families (parent, child, sibling, and any of their respective spouses) and household members (whether or not related) of ONE/SIZE (“Sponsor”), and each of their respective parent, subsidiaries, participating vendors, or affiliated entities.  The Contest is governed by the laws of the State of Florida, in the United States and is subject to all applicable, federal, state and local laws and regulation within the United States of America.  By entering the Contest, entrants agree to be accept and be bound by all terms of these Official Rules.  Void where prohibited by law.

Entrants must also be a registered user of one or all of the following social media websites TikTok, Instagram, Twitter, Snapchat, Facebook and/or YouTube (the “Social Media”) and comply with the terms of use posted on those respective websites.  To the extent of any conflict between Social Media website terms of use and these Official Rules, this Official Rules will apply. All Social Media accounts are free as of the date of publication of these Official Rules. If you post updates to, or receive updates from, Instagram or Facebook via SMS or through the internet from your mobile device, you may incur a charge from your wireless service provider.  Please consult your wireless service provider regarding your pricing plan. 

NOTE: This Contest is not sponsored, endorsed or administered by TikTok, Instagram, Twitter, Facebook, Snapchat and/or Youtube in any way. 

HERE’S HOW IT WORKS: To enter, the entrant will need to create a 15-second or less commercial-inspired video using any, or all, ONE/SIZE products and submit their video via onesizebeauty.com through the contest submission form (each an “Entry”), along with providing any other additional information required by Sponsor.  Each Entry must comply with and include the following:

• Must be less than 15 seconds
• Must show entrant posing to camera
• Must include entrant applying a ONE/SIZE product on camera
• Must include ONE/SIZE product focused clips
• It is recommended for Entry to use the Visionary song either with or without lyrics in the entry video, however, entrant may also use background music of their choice
• Must only use ONE/SIZE products in video. Entry can include other One Size products along with Visionary, however, no products from other companies or brands should be used or visible
• Entrant must post Entry on TikTok and/or Instagram tagging @onesize and using the hashtags #onesizebeauty and #StarrrSearch
• Entrant’s picture must not contain any visible logos, pictures, drawings, phrases, photographs or trademarks or other content or materials in which Entrant does not own or for which Entrant has not secured all the necessary rights
• Entry must comply with all other terms and conditions outlined in these Official Rules

Entrants who properly submit their Entry will be entered into the Contest.  Each Entry must be received by the date and time outlined above.  Final eligibility for the award of any prize is subject to eligibility verification and is in Sponsor’s sole discretion. 

WINNER SELECTION: Each Entry will be judged by Patrick Starrr and the ONE/SIZE Board (the “Judges”) and will be based on the Judges’ determination of creativity, effort and originality.  The Entry must follow the above guidelines to be eligible to win.  The top six (6) scoring Entries will be declared the Contest winners (collectively, the “Winners” and each individually a “Winner”). The Winners will be announced on September 30, 2020.  Judges reserve the right to disqualify any Entry that, in the sole opinion of the Judges, refers, depicts, or in any way reflects negatively upon the Sponsor, the promotion, any other person or entity, or does not comply with these Official Rules or ONE/SIZE’s terms and conditions.  Judges’ decisions are final and binding.

REQUIREMENTS OF WINNERS: A potential winner may be required to complete and return an Affidavit of Eligibility and Liability/Publicity Release within seven (7) days of prize notification.  If a potential winner fails to sign and return the Affidavit of Eligibility and Liability/Publicity Release within the required time period, he/she will be disqualified and an alternate entrant may be selected in his/her place.  

PRIZE: 

Approximate Prize Retail Value: $5,000 USD

• Videos featured in ONE/SIZE marketing, advertising, and in store environment.
• Winners will receive ONE/SIZE existing product + PR mailers for one calendar year (2021).

No substitution or transfer of prizes or cash redemption is permitted. Sponsor reserves right to substitute similar product. Any difference between stated value and actual value will not be awarded. Prizes are not transferable or redeemable for cash and prize substitutions will not be allowed, except at sole discretion of the Sponsor who reserves the right to substitute prizes of equal or greater value.  Winner is responsible for the reporting and payment of all federal, state and local taxes (if any) and any other costs and expenses associated with prize acceptance and use not specified in these Official Rules and/or in the applicable entry instructions as being provided. Prizes will be fulfilled within (one year from date of win) of Sponsor’s verification of Winner. All prize details and additional terms, conditions, or eligibility requirements are in Sponsor’s discretion.

ENTRY SUBMISSION: Entrant warrants and represents that the Entry (a) is original; (b) does not infringe the intellectual property, privacy, publicity rights, ownership or any other legal or moral rights of any third party; (c) has not been entered in previous contests or won previous awards; and (d) is suitable for public viewing.  

Entry must be the original work of the entrant, may not have been previously published, must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person and must not violate any law.  

By submitting the Entry, entrant grants Sponsor and its affiliates and assigns a worldwide, non-exclusive, royalty free, fully paid, sublicenseable and transferable license to use, reproduce, display, and create any derivative works of the Entry in perpetuity, including but not limited to editorial content and the Sponsor shall have the right to publish the Entry in any media format, including all social media channels and use in perpetuity the entrant’s name and likeness for any lawful purpose, including promotional purposes, without further compensation.

WINNER NOTIFICATION: Winner(s) will be notified by phone and email. In the event that it is determined that Winner has not complied with these Official Rules, has failed to execute and return any required documents within the specified time period, has made false statements or a prize notification is returned as undeliverable, then the Winner will be disqualified, and at the Sponsor’s sole discretion, the Entry with next highest score may then be declared the alternate Winner.  

GENERAL RULES: By entering this Contest entrant grants ONE/SIZE and their affiliates, assignees and designees the right, unless prohibited by law, to use their names, user names, submitted content, cities and states of residences, voices, avatars, pictures and likenesses, without compensation, notification or approval, for the purpose of advertising and publicizing the goods and services of the Contest and all matters related to the Contest, in any manner or medium, now or hereafter known, throughout the world in perpetuity. Information provided by Contest entrants may be used for additional marketing and advertising purposes or any other purpose by ONE/SIZE unless prohibited by applicable U.S. law or European General Data Protection Regulation ("GDPR"). By accepting the prize, the Winners agree to hold Sponsor, its respective directors, officers, employees, and assigns, harmless against any and all claims and liability arising out of use of the prize. Entrants agree to release, discharge and hold harmless Sponsor, its parent company, and their respective subsidiaries, affiliates, officers, directors, shareholders, employees, agents, attorneys, other representatives and advertising agencies, harmless from and against any and all liability and damages.  ONE/SIZE and its respective officers, directors, agents, representatives, and employees (collectively, the “Released Parties”) are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete, or delayed Entries; all of which will be void. The Released Parties are also not responsible for misdirected or undeliverable e-mail or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof.  Released Parties are not responsible for any typographical/other error in presentation/administration of Contest, prize announcements or for any liability for damages to any computer system resulting from participation in, accessing or downloading information in connection with this Contest. Sponsor reserves the right to modify, suspend or terminate the Contest in Sponsor’s sole discretion.

Except where prohibited, entrants agree that: (i) any and all disputes, claims and causes of action arising out of or connected with the Contest or any prize awarded will be resolved individually, without resort to any form of class action and exclusively by the appropriate court located in Florida; (ii) any and all claims, judgments, and awards to entrants will be limited to actual out of pocket costs incurred, including costs associated with participating in this Contest, but in no event attorneys’ fees; and (iii) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and consequential damages, and any other damages other than for actual out of pocket expense and any and all rights to have damages multiplies or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or entrants’ and/or Sponsor’s rights and obligations in connection with the Contest are governed by and construed in accordance with the laws of the State of Florida without giving effect to any choice of law or conflict of law rules. In the event of any conflict with any Contest details contained in these Official Rules and Contest details contained in Contest materials (including, but not limited to, point of sale, social media, website, radio, and print advertising, promotional packaging, and other promotion media), the details of the Contest as set forth in these Official Rules shall prevail.

USE OF DATA/ PRIVACY POLICY:  Sponsor will collect personal data about entrants online, in accordance with its Privacy Policy.  Any personally identifiable information collected during an entrant’s participation in this Contest will be used by Sponsor. Administrator, its affiliates, agents and marketers in accordance with Sponsor’s privacy policy, located at (https://www.onesizebeauty.com/pages/privacy-policy)
